JUSTICE SUDHIR SINGH ORAL ORDER 20-01-2016 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are apprehending their arrest in connection with Govindpur P.S. Case No. 72 of 2014 for the offences instituted under Sections 147, 148, 341, 323, 504, 307, 379 and 448 of the Indian Penal Code.
As per the prosecution case, some of the accused persons armed with various weapons came there and accused Punit Ram told to kill the informant and take the money upon which Awadh Ram having iron tangi in his hand and also other accused persons started assaulting with tangi and also took Rs.50,000/- of Indira Awas kept in a box stating that he will die and they fled away on seeing the villagers.
Patna High Court Cr.Misc. No.55086 of 2015 (3) dt.20-01-2016 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is a case and counter case. Both the parties are agnates. The injuries are simple in nature. No offence under Section 307 of the Indian Penal Code is made out, taking into account the injury report. The other coaccused have been granted anticipatory bail by this Court vide Cr.Misc.No.28889 of 2015.
On behalf of the State it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Govindpur P.S. Case No. 72 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
