Petitioner apprehends his arrest in Sultanganj ( Akbar Nagar) P.S. case no. 12/05 instituted for the offence under Section(s) 307, 324/34 of the Indian Penal Code and Section 27 of the Arms Act.

There is specific allegation against this petitioner of causing fire arm injury to the brother of the informant which hit in his waist and he fell down. Learned counsel for the petitioner has submitted that one of the co-accused has been tried and he has already been acquitted.

The learned sessions judge has mentioned in the impugned order that this case has been lodged in the year 2005 and since then the petitioner avoided his appearance in the case

Patna High Court Cr.Misc. No.15456 of 2018(2) dt.12-04-2018 2/2 for long time on account of which the trial has been hampered. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of on its own merit in accordance with law without being prejudiced by the present order.
