Petitioners apprehend their arrest in Narpatganj P.S. Case No.453 of 2017, registered under Sections 366(A), 370, 370(A), 371, 373, 120(B), 323, 504 and 34 of the Indian Penal Code.

The informant filed a complaint case on the basis of which the present FIR was lodged. The informant alleged that Shravan Kumar and Anuradha Devi took her child to Delhi but some how on the prestext of Mundan, the informant brought her child but again the accused persons kidnapped her child. Learned counsel for the petitioners submits that the informant had given the child in adoption to Shravan Kumar and

Patna High Court CR. MISC. No.25877 of 2019(2) dt.22-04-2019 2/2 Anuradha Devi. There is no allegation against Siddique @ Md. Siddique @ Siddik Alam, petitioner no.2. Md. Alam is a witness of the adoption deed. There is no allegation of kidnapping of minor boy against the petitioners.

Taking into consideration the facts and nature of allegations made against the petitioners and the fact that there is no allegation of kidnapping the victim, minor son of the informant, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria in connection with Narpatganj P.S. Case No.453 of 2017, subject to the conditions laid down under Section 438(2) Cr.P.C.
