====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 15-09-2020 Heard Mr. Rajeev Kumar, learned counsel for the petitioners and Mr. Ram Bilash Roy Raman, Additional Public Prosecutor for the state through video conferencing.

2. Petitioners seek regular bail in connection with Shahpur PS Case No. 437/2019 registered for the offence punishable under Sections 302 and 201/34 of the IPC.

3. The allegation against petitioners as per First Information Report is that the petitioners along with other accused persons have stabbed the husband of the informant leading to his death.

4. Learned counsel for the petitioners submits that the petitioners have falsely been implicated in this case due to

Patna High Court CR. MISC. No.23737 of 2020(2) dt.15-09-2020 2/3 family dispute. Learned counsel further submits that petitioner no.1 is mother and petitioner no.2 is sister of the deceased respectively. Learned counsel referring to the FIR submits that specific allegation of assault by means of knife is upon Sunil Ray and Niranjan Ray. Learned counsel also submits that no overt act has been alleged against these two petitioners. Learned counsel further submits that similarly situated co-accused, Anil Ray has been granted bail by one of the Co-ordinate Benches of this Court in Cr. Misc. No. 5894/2020.

Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that there is no specific allegation of assault against the petitioners and further similarly situated co-accused, Anil Ray has already been granted bail by this Court in Cr. Misc. No. 5894/2020 , I am inclined to grant regular bail to the petitioners.

Accordingly, let the petitioners, MEENA DEVI AND RANI DEVI @ RANI KUMARI @ DHARMSHILA DEVI be released on bail, if they are not required in any other case, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Danapur, Patna in connection with Shahpur PS Case No. 437/2019.

7. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines regarding lockdown and social distancing.
