Petitioner apprehends his arrest in connection with Jakkanpur P.S.Case No. 168 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. Petitioner is not named in the FIR and it appears that during course of investigation his name transpires. Submission of learned counsel for the petitioner is that except the information given by spy there is nothing against him and no overt act has been alleged against him. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.10764 of 2018 (3) dt.03-04-2018 2/2 Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub Judge 1st cum A.C.J.M., Patna, in connection with Jakkanpur P.S.Case No. 168 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that (1) one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and (2) petitioner shall co-operate in investigation and appear before the Investigating Officer as and when required, except on genuine ground, failing which his bail bond shall be cancelled.
