Mr. S.S. Sundaram, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 13-07-2023 On call, no one appears on behalf of the petitioner although the State and the learned Counsel for the Bihar Staff Selection Commission are present.

The present petition has been filed for compliance of the order dated 01.10.2010/08.11.2010 passed in CWJC No. 6303 of 2010.

It has been contended by Mr. S.S. Sundaram that against the order, an LPA 1088 of 2011 was preferred by 'the Commission' and during the pendency of the said appeal, the petitioner-respondent was recommended to be appointed for the post of Sub-Inspector.

In that view of the matter, the LPA No. 1088 of 2011 was disposed of as infructuous and the said order dated 12.10.17 is incorporated hereinbelow:-

Patna High Court MJC No.1093 of 2011(7) dt.13-07-2023 2/2 "Now in view of the subsequent developments that have taken place by which the name of the respondents for appointment to the post in question have been recommended in the list published by the Commission in the general category, these appeals by the Bihar Staff Selection Commission stand rendered infructuous.

In view of the above, both the appeals stand disposed of as having been rendered infructuous."

Taking into account the aforesaid fact, the contempt petition has also become infructuous.

Accordingly, the M.J.C. No. 1093 of 2011 stands disposed of.
