The petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 120(B) and 34 of the Indian Penal Code.
The informant lodged a case against the petitioner after recovery of dead body of his son Deobrat. The informant alleged that the petitioner and others might have killed his son. It is submitted that there is no eye-witness of the occurrence. Save and except the suspicion, no material has been collected so far showing involvement of the petitioner. Co-accused Chandan Kumar and Bandan Kumar have been enlarged on anticipatory bail vide order dated 26.06.2015 passed in Cr. Misc. No. 14508 of 2015 and Lallu Kumar has also been enlarged on bail vide order
Patna High Court Cr.Misc. No.33467 of 2015 (3) dt.27-11-2015 P2/2 passed in Cr. Misc. No. 31607 of 2015. It is submitted that the case of the petitioner stands on similar footing. Learned Additional Public Prosecutor for the State did not dispute the above fact and submits that save and except the suspicion, there is no material to show the involvement of the petitioner.
Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the learned Chief Judicial Magistrate, Nalanda at Biharsharif in Bihar P.S. Case No. 447 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
