The petitioner is in judicial custody in connection with Nawada Nagar Bundelkhand P.S. Case No. 1442 of 2022 registered under Sections 147, 149, 148, 323, 326, 307, 379, 385, 504 and 506 of the Indian Penal Code lodged on 20.11.2022 by the informant, Suraj Kumar.

As per the prosecution story, the allegation is that there was some dispute regarding preparing of the chicken, infuriated, he resorted to continuous knife blows on the body of the injured, one of which was in between the eyes and the ear, a vital organ. Accordingly, the FIR It is the case of the petitioner that he has already suffered by being in custody for last nine (9) months.

Patna High Court CR. MISC. No.33883 of 2023(3) dt.24-08-2023 2/2 Learned APP has drawn the attention of the Court to the FIR to show that the petitioner had repeatedly stabbed the informant.

Taking into account the allegation that has come against the petitioner, this Court is not extended the benefit of bail for the present, which is accordingly rejected. However, the Trial Court is directed to expedite the trial and conclude the same at an earliest.
