2. Petitioners seek pre-arrest bail in connection with Nabinagar P.S.Case No.10 of 2025, GR No.75 of 2025, registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 117(2), 109, 352 & 351(2)

3. At the very outset, learned counsel appearing on behalf of the petitioners seeks permission to withdraw the present bail application filed on behalf of petitioner no.1 (Lalan Sao).

4 Permission granted.

5. Accordingly, the present bail application filed on behalf of the petitioner 1 is dismissed as withdrawn.

6. So far as petitioner nos. 2 to 10 are concerned, as per the allegation made in the FIR, the petitioners along with the co-accused Ranjan Sao with a common intention to kill the informant assaulted with iron rod. The specific allegation of assault is against co-accused Ranjan Sao.

7. Learned counsel appearing on behalf of the petitioners submitted that in view of specific allegation of assault against Ranjan Sao and there is general and omnibus allegations against the petitioners, as well as, there is no allegation of overtact against the petitioners, the petitioners seek to be released on pre-arrest bail.

8. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.

9. Having considered the rival submissions made on

No.25032 of 2025(2) dt.05-05-2025 3/3 behalf of the parties, as well as, considering the specific allegation against co-accused Ranjan Sao and there is general and omnibus allegation against the petitioners, petitioners no.2 to 10 are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned district court within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-I, Aurangabad/concerned court, in connection with Nabinagar P.S.Case No.10 of 2025, G.R. No.75 of 2025, subject to conditions as laid down under Section 482(2) of BNSS of 2023.

10. The learned district court is directed to verify the criminal antecedent of the petitioners and if it is found that the petitioners are involved in some other cases as what has been stated in paragraph No.3 of the bail application, this order will automatically lose its force.
