JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 393/414 of the Indian Penal Code and 25(1-b)a/26/35 of the Arms Act.

Petitioner and one other are said to have been caught when they assembled near Bashaniwa Road and on search one country-made loaded Katta and one live cartridge are said to have been recovered from the conscious possession of the petitioner. Furthermore, one motorcycle has also been recovered from the possession of the petitioner and other apprehended accused.

From perusal of paragraph 3 of the petition, it appears that petitioner does not have any criminal antecedent. Submission on behalf of the petitioner is, as a matter

No.24664 of 2019(2) dt.19-04-2019 2/2 of fact, that nothing was recovered from the conscious possession of the petitioner and, while petitioner was returning to attend Tilak ceremony, police arrested him on suspicion. The petitioner does not have any concerned with the seized motorcycle. It is further pointed out on behalf of the petitioner that seizure list does not bear the signature of the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate XI, Bhojpur / concerned court in connection with Jagdishpur P.S. Case No. 20 of 2019.
