JUSTICE ARVIND SRIVASTAVA ORAL ORDER 07-07-2023 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. Petitioners apprehend arrest in connection with Bettiah Complaint Case No. 1343 (C) of 2022/ T.R. No. 495 of 2022 instituted for the offence under sections 120B, 147, 324, 342, 354B, 380, 387/34 of the Indian Penal Code.
Patna High Court CR. MISC. No.27024 of 2023(2) dt.07-07-2023 2/2 Learned counsel for the petitioners submits that petitioners have not committed any offence as alleged in the complaint petition. The present complaint case has been filed after 3 days of the alleged occurrence without there being explanation for the delay. Except petitioner no. 6, rest petitioners have no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named, are directed to be released on bail on furnishing personal bond to the satisfaction of Judicial Magistrate, Bettiah, West Champaran in connection with Complaint Case No. 1343C of 2022/ T.R. No. 495 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
