JUSTICE SANJAY PRIYA ORAL ORDER 3/ 09-11-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Araria P.S. Case No.276 of 2016 instituted for the offence under Section(s) 341, 323, 325, 307/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Araria.

It is alleged against the petitioner that he assaulted the Informant with Dabiya on his neck, but he saved himself with the help of Gamcha and thereafter this petitioner along with two others cut his left wrist with Dabiya.

Case diary has been received. Injury report of the injured is available in para 53 of the case diary, wherein, doctor has found the injury to be grievous in nature. It is mentioned that amputation of left wrist was done.

Patna High Court Cr.Misc. No.47496 of 2017 (3) dt.09-11-2017 2/2 In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law on its own merit without being prejudiced by this order.
