The petitioner apprehends her arrest in connection with Chandan P.S. Case no. 45 of 2017, registered under Sections 420 and 468 of the Indian Penal Code and Section 136(1) of the Representation of Peoples Act.
The accusation is of inserting the name of petitioner Neetu Singh, wife of Suman Kumar Suman and Babita Kumari, wife of Mantu Yadav illegally in the Voter List of Gram Panchayat, Asurah by vendor M/s Creative, Banka. Learned counsel for the petitioner submits that allegation has been made against the petitioner inserting his name in the voter list illegally. Further submission is that
Patna High Court Cr.Misc. No.8773 of 2018(2) dt.17-02-2018 2/2 similarly situated co-accused Babita Kumari has already been allowed privilege of pre-arrest bail vide order dated 17.01.2018 passed in Criminal Miscellaneous No. 2428 of 2018 by a coordinate Bench of this Court. The petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Bhagalpur in connection with Chandan P.S. Case No. 45 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
