The petitioners being the Panchayat Mukhiya and Panchayat Secretary are apprehending their arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 120B/34 of the Indian Penal Code. It is alleged that there are three days difference in the date of the death of the father of the informant in the death certificate.
It is submitted by learned counsel for the petitioners that the certificate was prepared on the application made by the informant where the date of death was examined
Patna High Court Cr.Misc. No.55940 of 2015 (2) dt.09-12-2015 2/2 and it was recommended by the Anganwari Sevika also. Moreover, the said death certificate has not been misused. Considering the nature of accusation, let the above named petitioners be released on anticipatory bail, in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Sandesh P.S. Case No. 142 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
