The petitioner is apprehending his arrest in connection with Supaul Mahila P.S. Case No. 35 of 2017 registered for the offences punishable under Sections 366, 376, 504 and 506 of the Indian Penal Code.

Allegation against the petitioner is of making physical relationship with the informant on the assurance of marriage. It has been submitted on behalf of the petitioner that FIR itself shows that she was a consenting party and she was major and, as such, no case under Section 376 IPC is made out against the petitioner.

Heard learned APP also, who has opposed the prayer for anticipatory bail.
