JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-12-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504 and 506/34 of the Indian Penal Code.
The prosecution case is that the informant and others went to Angan Barhi Centre of petitioner no.1 then they were abused by petitioner no.2.
It is submitted by learned counsel for the petitioners that petitioner no.1 is the In-charge of petitioner Angan Barhi Centre where the villagers committed theft when petitioner no.1 lodged Jagdishpur P.S. Case No. 172 of 2015 levelling accusation under Sections 341, 323, 504, 379 and 427/34, hence as a retaliatory
Patna High Court Cr.Misc. No.54657 of 2015 (2) dt.03-12-2015 2/2 measure, the present case has been lodged. Petitioner no.2 is the husband of petitioner no.1. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent. Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur in connection with Jagdishpur P.S. Case No. 173 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
