JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 01-09-2022 Heard learned counsel for the petitioners, learned counsel for the informant and learned APP for the State. Learned counsel for the petitioners undertakes to remove the defects within four weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within stipulated period, the office will place the matter before the Bench.
The petitioners apprehend their arrest in a case registered for the offence punishable u/s 341/323/498(A)/504/506 and 34 of the IPC and sections 3⁄4 of D.P. Act.
Patna High Court CR. MISC. No.26953 of 2022(2) dt.01-09-2022 2/3 Allegation against the petitioners is of committing torture upon the victim due to non-fulfillment of demand of dowry. It is also alleged that they snatched her child and ousted her from the matrimonial house.
It is submitted by learned counsel for the petitioners that petitioners are innocent and have committed no offence. Petitioners have never made any dowry demand and has been falsely implicated in the present case due to grudge. Petitioner no.1 is father-in-law and petitioner no.2 is mother-in-law of the informant. There is general and omnibus allegation against the petitioners. Petitioners have no criminal antecedent.
Considering the aforesaid facts and circumstances, let the petitioners, named above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail, on furnishing bail bonds of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below, where the case is pending/Successor court, in connection with Bhojpur Mahila P.S. Case No.13 of 2022, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
