2.The petitioners seek bail in connection with Fathua P. S. Case No. 40 of 2010, dated 29-01-2010, instituted for offences punishable under Section 304(B), 201, 120B and 34 of the Indian Penal Code.
3. The allegation against the petitioners is that they killed the informant's daughter after three years of marriage due to non-fulfillment of dowry demands.
4. Learned counsel for the petitioners submits that the
Patna High Court CR. MISC. No.29199 of 2025(2) dt.15-05-2025 2/3 petitioners are innocent and the have been falsely implicated in the present case. It is further submitted that the petitioners are brothers of the deceased's husband. Further submission is that husband, father-in-law, and mother-in-law of the deceased have been granted bail by different Co-ordinate Benches of this Court vide orders dated 15.05.2013, 02.09.2011 and 09.10.2013 passed in Cr. Misc. Nos. 16698 of 2013, 28540 of 2011 and 34270 of 2013, respectively. Copies of these bail orders have been annexed to the bail petition as Annexure P3 series. It is further submitted that the petitioners had no knowledge about the present case, and after being made aware of it, they voluntarily surrendered before the court below on 31.01.2025. Since then, they have been in judicial custody. It is also submitted that the petitioners have no criminal antecedents.
5. Learned Additional Public Prosecutor (APP) for the State has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned JM 1st Class, Patna City, in connection with Fathua P. S. Case No. 40 of 2010.

7. The application stands allowed.
