JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Siwan Town Police Station Case No. 429 of 2016 registered for the offences punishable under Sections 379, 411, 413/34 of the Indian Penal Code.

According to the prosecution case itself, one coaccused Md. Miraj Ali was caught on the spot and disclosed the name of three persons. The said co-accused Md. Miraj Ali did not disclose the name of petitioner at the time of registration of the present case but, subsequently, when his confessional statement was recorded, he disclosed the name of petitioner also. Petitioner does not have any criminal antecedent.

No.45151 of 2016 (2) dt.22-12-2016 2/2 Accordingly, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Siwan Town P.S.Case no. 429 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
