Petitioner is in custody in connection with NDPS Case No.02 of 2020 arising out of Ahiyapur P.S.Case No.23 of 2020 for the offence under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)a/26/35 of the Arms Act as well as Section 20 and 22 of the NDPS Act.

Learned counsel for the petitioner would submit that the petitioner has clean antecedent.

In the instant case petitioner along with others have been apprehended by the police on the allegation of preparing for commission of crime. From the possession of this petitioner, two live cartridges were recovered. Petitioner is in custody since

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 05.01.2020, the Court is inclined to grant bail to the petitioner, let the petitioner above named be released on bail on or after 08th of November, 2020 on furnishing bail bond of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Ahiyapur P.S. Case No.23 of 2020 (NDPS Case No.02 of 2020).
