JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 21-09-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Sahar P.S.Case No. 87 of 2017 registered under Sections 420, 467, 468 and 34 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the admitted case of the prosecution is that the forged medical certificates were issued under the signature of Dr. Neyaz Ashraf Siddiqui and the name of the petitioner has been impleaded in the FIR only on suspicion as the stamp in the name of In-charge Medical Officer was also put over the certificates. He has submitted that the rubber stamp can be prepared by anyone and as the admitted case of the prosecution is that the petitioner

Patna High Court Cr.Misc. No.41696 of 2017 (2) dt.21-09-2017 2/2 has not put his signature on any of the medical certificates, his implication in the present case is baseless.

On the other hand, learned counsel for the State has submitted that the name of the petitioner has been given as a conspirator in the alleged offence of issuance of forged medical certificates.

Be that as it may, regard being had to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-X, Bhojpur, Ara in connection with Safar P.S.Case No. 87 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
