JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 18-12-2015 Heard learned counsel for the petitioner and the respondents.

The petitioner seeks refund of Rs.3,82,354/-, which was recovered from his salary as well as payment of full salary and allowances for the period of suspension, as his punishment has been quashed by this Court vide order dated 27.01.2012, passed in C.W.J.C. No. 4525 of 2005. A counter affidavit has been filed on behalf of respondent no.5 (Accountant General, Bihar). It has been submitted that the entire admissible dues of the petitioner; eg. (payment bill) etc. have been authorized. The pension,

Patna High Court CWJC No.2382 of 2013 (3) dt.18-12-2015 2 / 2 gratuity and leave salary have been revised in terms of the pay revision commission report. Furthermore, the department has restored two increments, which was withheld by the Department. In view of the submissions made on behalf of the learned counsel appearing on behalf of Accountant General, Bihar as well as the averments made in the counter affidavit, I am of the view that the grievance of the petitioner, prima facie, has been taken care of.

In case, the petitioner is still aggrieved, it will be open for him to file representation before the appropriate authority.

This application stands disposed of.
