2. The petitioners seek bail in connection with Rajgir PS Case No.542 of 2022 dated 21.09.2022, instituted for the offence punishable under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.

3. The prosecution case, in short, is that the informant, who is a Sub Inspector, got information during the course of patrolling that some cyber criminals are cheating the common people near the house of Sidhesh Prasad, Mohalla- Panditpur. The informant along with other police personnel reached there and saw 3-4 persons in the Galli and they started fleeing away

Patna High Court CR. MISC. No.26910 of 2023(2) dt.25-05-2023 2/2 on seeing the police. Two persons were caught, who disclosed their names as Pintu Kumar and Tinku Kumar. Upon search, papers relating to approval of loan from Dhani Instant Personal Loan, PAN, Aadhar Card etc. were recovered.

Learned counsel for the petitioners submitted that the allegation against the petitioners is that they are involved in cyber crime and were duping the villagers on the pretext of approval of personal loan, but no one has claimed before the police that he has been cheated in the name of approval of loan and has received any amount. Learned counsel further submitted that the petitioners are in custody since 22.09.2022 having clean antecedent and charge-sheet has been submitted in the case.

5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in Rajgir PS Case No.542 of 2022.
