In relation to an occurrence committed in the year 2012 under Sections 366A/34 of the Indian Penal Code wherein the petitioners are named in the F.I.R., a prayer for grant of anticipatory bail has now been made by the petitioners. It is stated that the incriminating material against the petitioners, if any, has come several years after the incident. They are not directly related to the main accused who kidnapped the minor daughter of the informant. Learned APP opposed the prayer and submits that the trial of some accuseds is going on. Petitioners may be treated as the absconders. He placed the impugned order wherefrom it appears the material incriminating the petitioners have been collected in
Patna High Court Cr.Misc. No.38748 of 2017(3) dt.19-09-2017 2/2 course of investigation.
Considering the facts and circumstances of the case, this Court is not inclined to direct release of the petitioners on anticipatory bail. Prayer is rejected.
