The petitioner apprehends his arrest in a case registered for the offences under Sections 366(A) and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has antecedent of one case and the informant alleges that petitioner along with other accused persons kidnapped his sister.
Learned counsel for the petitioner submits that from perusal of Annexure-2 i.e., the statement of victim under Section 164 of the Cr.P.C., it would manifest that she has disclosed her age as 20 years and has not supported the prosecution case. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.35084 of 2021(2) dt.13-06-2022 2/2 anticipatory bail of the petitioner.
Considering the fact that the victim has not supported the prosecution case, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sonbarsa Raj P.S. Case No. 157 of 2020 subject to the conditions as laid down under Section 438
(2) of the Cr.P.C.
