The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 149, 153, 186, 188, 189, 225, 290, 332, 333, 353, 341,323, 307, 504 and 506 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other F.I.R. named accused and 15-20 unknown persons created hindrance in discharge of official duty of police party. They also committed assault with police personnel and snatched the police paper and thereafter, got released the arrested co-accused. It is submitted on behalf of petitioner that allegation of assault is general and omnibus. No specific overt act has been alleged against this petitioner. Specific allegation of assault is against co-accused Musabbir. Petitioner is only alleged to be member of the mob and has got clean antecedent.

Patna High Court CR. MISC. No.27322 of 2022(2) dt.22-09-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances as well as clean antecedent, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria in connection with Jokihat (Mahalgaon) P.S. Case No. 594 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
