Criminal Miscellaneous No.46821 of 2017 Arising Out of PS. Case No.-111 Year-2017 Thana- PRANPUR District- Katihar ====================================================== Rajesh Kumar Chaudhary @ Rajesh Chaudhary, son of Jangali Chaudhary, resident of Teli Tola, P.S.- Pranpur, (Roshna), District- Katihar. ... ... Petitioner/s
Versus
The State Of Bihar ... ... Opposite Party/s ====================================================== Appearance :
For the Petitioner/s :
Mr. Ajit Kumar Singh For the Opposite Party/s :
Mr. SRI RAMCHANDRA SINGH ====================================================== CORAM: HONOURABLE MR. JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 21-09-2017 Heard Mr. Ajit Kumar Singh for the petitioner and Mr. Dayal, APP for the State.
Apprehending his arrest in Pranpur (Roshna) P.S. Case No. 111 of 2017 registered under sections 363, 366A/34 of the Indian Penal Code, the present application is filed for grant of anticipatory bail.
The allegation is of abducting/kidnapping the minor daughter of the informant. Learned counsel submits that owing to the dispute over payment of tuition fee, the F.I.R. has been lodged with concocted allegations. From the F.I.R. and the impugned order, it appears the victim, on retrieval, in her statement under Section 164 Cr.P.C. has clearly implicated the petitioner.
Patna High Court Cr.Misc. No.46821 of 2017(2) dt.21-09-2017 2/2 In my view, it is not a fit case for grant of anticipatory bail. Prayer is rejected.
