The appellants seek pre arrest bail in connection with Imamganj P.S.Case No.67 of 2017 registered for offences punishable under Sections 341, 447, 323, 504 and 506 of the Indian Penal Code and section 3(i)(s) of SC/ST (Prevention of Atrocities) Act.
Allegation against the appellants is of abusing the informant by taking caste name and also assaulting by fists and slaps.
Submission of the learned counsel for the appellants is that they have been falsely implicated in this case and no such
Patna High Court CR. APP (SJ) No.2404 of 2017 (2) dt.13-09-2017 2/2 occurrence has taken place and earlier to that a case is pending against the informant due to land dispute. Further submission is that the land belongs to him, which will appear from Annexure 4 and 4/A of the petition Heard learned Special P.P. also, who has opposed the prayer for bail.
Having heard both sides, this appeal is not maintainable.
Let the appellant surrender before the court of Special Judge and prayer for bail, which will be considered by the learned Special Judge on the basis of submissions as made above and also considering the same, he will dispose of the same, if possible on the same day without being prejudiced by the order of this Court. With the above observation, this appeal is disposed of.
