JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-12-2015 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 376, 511, 452, 380 of the Indian Penal Code and Section 3(1)(x((xi)(xiv) of the SC & ST (Prevention of Atrocities) Act.

The prosecution case is that when the informant along with her daughter-in-law went to ease out on the road, the accused persons abused by calling caste name and tried to outrage the modesty. The accused persons entered into the house of the informant, took out Rs. 30,000/- and cow worth Rs. 35,000/-.

It is submitted by learned counsel for the petitioners that petitioners' side lodged Warisaliganj P.S. Case No. 144 of 2014 on 08.07.2014 against the informant and

Patna High Court Cr.Misc. No.56048 of 2015 (2) dt.10-12-2015 2/2 thereafter the present complaint was filed on 27.08.2014 which came to be registered as police case on 09.05.2015. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the case lodged by the petitioners' side at earlier point of time, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nawada in connection with Nawada SC/ST P.S. Case No. 33 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
