The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 308, 379/34 of the Indian Penal Code.

As per the prosecution case, the informant used to give tuition to the grandson of Upendra Jha. During that period, petitioner no. 4 the grand-daughter of Devendra Jha used to pass loose comments on the informant and when informant complained Devendra Jha and his father about this occurrence,

Patna High Court CR. MISC. No.27077 of 2023(2) dt.07-07-2023 2/2 all the FIR named accused persons came and petitioner no. 1 assaulted him with iron rod. Petitioner no. 2 snatched gold ring and all the accused persons snatched Rs. 3000/- from his pocket. Petitioner no. 3 assaulted him with Jharu.

It is submitted that petitioners have been falsely implicated in this case. There is case and counter case. The doctor has found the injury sustained by the injured simple in nature. Petitioners have got clean antecedent. Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Jhanjharpur, Madhubani in connection with (Arariya Sangram OP) Jhanjharpur P.S. Case No. 208 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
