====================================================== CORAM: HONOURABLE MR. JUSTICE ALOK KUMAR PANDEY ORAL ORDER 17-05-2023 Heard learned counsel for the petitioner and learned counsel for the Vigilance.

The present petitioner has been filed for modification of order dated 18.08.2022 passed by this court in Cr. Misc. No. 14821 of 2022, whereby and whereunder the petitioner was granted bail on certain conditions and he wants for exemption from the part of condition no. (iv) which says that "petitioner shall get his presence marked before the Officer-In-charge of the concerned Police Station on the first Tuesday of every month." Learned counsel for the petitioner submits that in compliance of the condition No.(iv), of the bail order dated 18.08.2022, the petitioner has been appearing before the Officer-In-Charge, Vigilance Police Station, Patna and getting

He is government servant and at present he is under suspension and has been posted at Gaya, therefore, it has become difficult for the petitioner to come Patna on every first Tuesday of the month. Hence, he prays that part of condition no. (iv) be modified in the context of his personal difficulty.

Learned counsel for the Vigilance does not raise objection.

In the light of aforesaid submission, condition no. (iv) of order dated 18.08.2022 passed by this court in Cr. Misc. No. 14821 of 2022 is modified to the extent that "petitioner shall get his presence marked before the Officer-In-charge of the concerned Police Station on the first Tuesday of every month." In the aforesaid manner, the modification petition stands disposed of.
