2. The petitioner is apprehending his arrest in connection with Nadi P.S. Case No. 60 of 2019 for the offence under Sections 302 and 34 of the I.P.C. lodged on 10.03.2019 by the informant, Saraswati Devi.

3. As per the prosecution story, the lady saw her husband dead and a towel surrounding his neck, she raised alarm, the locals came and further in the FIR named amongst other, this petitioner.

4. Learned APP pointed out that the case is under Section 302 of the Indian Penal Code, lodged in the year 2019, the petitioner was named and he took five years to seek anticipatory bail.

5. Considering the aforesaid submission of the learned

Patna High Court CR. MISC. No.28933 of 2024(2) dt.15-05-2024 2/2 APP that the petitioner despite being an accused in a case of Section 302 of the Indian Penal Code chose five years to approach the Court for grant of anticipatory bail, no relief can be granted.
