The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 427, 504 and 385/34 of the Indian Penal Code. The accusation is of stopping the car of the informant, demanding extortion and on protest being made the informant was assaulted by iron rod and his fifty thousand rupees and mobile were snatched.

It is submitted by learned counsel for the petitioner that for the occurrence of 20.07.2015 the FIR was lodged on 22.07.2015 whereas the petitioner lodged case against the informant on 20.07.2015 itself making accusation

Patna High Court Cr.Misc. No.55888 of 2015 (2) dt.09-12-2015 2/2 under Sections 341, 323, 307, 385, 504/34 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. The injury has been found to be simple in nature and a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the delayed lodging of the case and the case lodged by the petitioner at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Nautan P.S. Case No. 103 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
