JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-09-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Sigori P.S. Case No. 78 of 2015 registered under Sections 302 and 201/34 of the I.P.C. pending in the Court of Judicial Magistrate, 1st Class, Danapur, Patna.

The allegation of informant Rinki Devi is that on 02.08.2015, her husband, Shambhu Bind, was called by Tarwa @ Binod Choudhary. After sometimes, her brother-in-law Guddu Kumar saw that Tarwa along with Shambhu Bind and five others were taking wine. When Guddu Kumar asked to his brother Shambhu Bind to return at house then they told that Shambhu Bind will return on the next day, but her husband did not return

Patna High Court Cr.Misc. No.38775 of 2016 (2) dt.28-09-2016 2/2 and on the next day, her dead body was found without head in canal.

Learned counsel appearing on behalf of the petitioner submits that except the suspicion, there is nothing against the petitioner to show his hand in the murder of deceased husband of the informant.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to allow the prayer of the petitioner for anticipatory bail. Accordingly, this application is rejected.

However, petitioner is directed to surrender before the Trial Court and pray for regular bail, which shall be decided on its own merit without being prejudiced by this order. (Rajendra Kumar Mishra, J) Shail/- U T
