1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Bidupur P.S. Case No. 207 of 2022 registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that the petitioner has antecedent of two cases.

4. The informant alleges that her sister-in-law was sleeping along with her nephew, when some unknown thieves entered the house and committed theft of mobile and when her sister-in-law tried to catch the thieves, they fled away by throwing chilly powder on her. It is next alleged that on the same day, theft was committed in the house of Kapal Ram,

Patna High Court CR. MISC. No.29921 of 2023(2) dt.26-07-2023 2/3 Sundeshwar Ram and Dinesh Ram, further, one Ramavati Devi in whose house also a theft was committed some days ago, had named the petitioner as an accused.

5. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case based on suspicion, it is further submitted that the from perusal of the allegation as alleged in the FIR, it would manifest that the informant named the petitioner as an accused in the case on the ground that Ramavati Devi, in her FIR, had also named the petitioner as an accused. Learned counsel next submits that house of the petitioner along with Ranjeet was raided by the police, but nothing was recovered from the house of the petitioner though some theft article was recovered from the house of Ranjeet.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

7. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount

Patna High Court CR. MISC. No.29921 of 2023(2) dt.26-07-2023 3/3 each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Bidupur P.S. Case No. 207 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

8. One of the bailors of the petitioner shall be his mother Sunita Devi.
