JUSTICE SANDEEP KUMAR ORAL ORDER 23-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seek regular bail in connection with Karjain P.S. Case No. 19 of 2023, registered for the offence punishable under Sections 25(1-b)a, 26, 35 of the Arms Act. Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Petitioner has got no criminal antecedent. Petitioner is in custody since 18.01.2023.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail

Patna High Court CR. MISC. No.27086 of 2023(2) dt.23-05-2023 2/2 after completing six months in custody or after framing of charge, whichever is earlier on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Birpur, District- Supaul in connection with Karjain P.S. Case No. 19/2023.
