The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 498(A)/323/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.
On the last occasion, this Court had passed interim order in favour of the petitioner and directed both the parties to be personally present so that, if possible, the case and dispute between the parties may be resolved. However, today the opposite party No. 2 is present in person and so is the petitioner. After hearing learned counsel for the petitioner and learned counsel for the State as well as learned counsel appearing on behalf of the opposite party No. 2 and also because opposite party No. 2
Patna High Court Cr.Misc. No.47701 of 2016 (4) dt.08-02-2017 P2/2 has herself admitted that she had re-married and is living happily with another person, let the abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Madhepura, in connection with Madhepura Mahila Police Station Case No. 05/2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
