JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 05.04.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Minapur P. S. case no. 500/2017 registered under section 414/34 of the IPC.

Police raided the house of co-accused Akash who disclosed that he had taken stolen motorcycle in the garage of the petitioner who removed engine of the aforesaid motorcycle and replaced the same in the motorcycle of coaccused Akash. Although co-accused Akash claimed that the petitioner was aware of this fact that the aforesaid motorcycle was stolen property but submission on behalf of

Patna High Court Cr.Misc. No.19441 of 2018 (2) dt.05-04-2018 the petitioner is that the petitioner being mistri removed engine and replaced the same into another motorcycle without knowing the fact that the said motorcycle was a stolen property.

Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in Minapur P. S. case no. 500/2017 subject to condition as laid down under section 438(2) of the Cr.P.C.
