Petitioner apprehends his arrest in Panjwara P.S. Case No.123 of 2018, registered under Sections 307 and other Sections of the Indian Penal Code.
The informant alleged that while he was ploughing his field, Sakhchan Das, Mithilesh Das, Lakho Devi, Alka Kumari and Khusbu Kumari came and began to abuse the informant. The informant replied that he is the owner of the land. On such reply Sakhchan Das assaulted the informant Kailash Kumar Das on his head with iron rod. When Kapil Das, nephew of the informant, came to save, the petitioner Mithlesh Das said to have assaulted him with iron rod on his head. Patna High Court CR. MISC. No.27910 of 2019(2) dt.29-04-2019 2/2 got one lacerated wound on parietal region, which is superficial and simple in nature. There is no repetition of blow. Considering the facts that occurrence took place due to land dispute and the blow inflicted by the petitioner caused simple injury, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1, Banka in connection with Panjwara P.S. Case No.123 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
