JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307 and 379 of the Indian Penal Code and Section 27 of the Arms Act. It is alleged that initially the petitioner attempted to fire but the same misfired and thereafter he assaulted the informant with garasa causing injury on the head and fracture of the hand. It is submitted by learned counsel for the petitioner that though the fracture of shaft of ulna of right forearm has been found by the doctor but the apparent injury has been found to swelling of right forearm. The other injury has been found to be lacerated marginal in size simple in nature on frontal region of skull. It is further submitted that the injury has been caused by

Patna High Court Cr.Misc. No.54730 of 2015 (2) dt.04-12-2015 2/2 hard and blunt substance when the petitioner is alleged to have assaulted with sharp cutting weapon. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua in connection with Bhabua (Sonhan) P.S. Case No. 568 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Amrendra/- U T
