JUSTICE SANJAY PRIYA ORAL ORDER 28-02-2018 Heard learned counsel for the petitioner and the State. Prayer for bail of this petitioner was earlier rejected by this Court vide order dated 11.01.2018 passed in Cr. Misc. 48853 of 2017.

This second anticipatory bail application has been filed on behalf of the petitioner on the ground that one of the coaccused Vikram Kumar @ Rana with similar allegation has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 18.01.2018 passed in Cr. Misc. 3013 of 2018. From the aforesaid order, it does not appear that earlier order passed by this Court was brought to the notice of Hon'ble Judge at the time of passing order in Cr. Misc. 3013 of 2018. This Court does not find a good ground for grant of

Patna High Court Cr.Misc. No.10078 of 2018 (2) dt.28-02-2018 2/2 anticipatory bail to the petitioner only because one of the coaccused has been granted anticipatory bail by coordinate Bench of this Court after rejection of anticipatory bail of this petitioner earlier.

Therefore, this Court does not find any merit in this anticipatory bail application.

Prayer for anticipatory bail of the petitioner stands rejected.

Petitioner may surrender before the court below and make prayer for regular bail which shall be considered by the court below in accordance with law without being prejudiced by this order.
