The petitioner is apprehending his arrest in connection with Banka P.S.Case No. 188 of 2017 for the offences under Sections 147, 149, 337, 353, 431, 427 and 438 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against this petitioner is general and omnibus in nature. He further submits that similarly situated co-accused persons have already been extended the privilege of anticipatory bail by other Co-ordinate Benches of this Court vide orders dated 06.7.2017 passed in Cr. Misc. No. 28598 of 2017 , Cr. Misc. No. 29210 of 2017 and on 11.08.2017 passed in Cr. Misc. No. 37909 of 2017, respectively. The case of this petitioner stands on similar footing
Patna High Court Cr.Misc. No.38165 of 2017 (2) dt.17-08-2017 2/2 and so he also deserves anticipatory bail.
The learned A.P.P. opposed the submissions.
Considering the case of this petitioner on similar footing, facts and circumstances, the prayer of anticipatory bail is allowed. The petitioner, above named in the event of his arrest or surrender before the Court below within six weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S.Case No. 188 of 2017, subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
