Petitioner seeks bail in S. Tr. No.62 of 2019 arising out of Allauli P.S. Case No.40 of 2016 instituted for the offence under Section(s) 341, 323, 325, 307/34 Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner submits that Petitioner is in custody since 28.04.2018. There is no specific allegation against him in the written report. There is no recovery from his possession. No Test Identification Parade has been held. First Information Report named accused persons have been granted anticipatory bail.

In the written report, there is allegation against named accused persons of assaulting the informant with iron rod on his

Patna High Court CR. MISC. No.25128 of 2019(2) dt.22-04-2019 2/2 head and also snatching rupees forty five thousand from dickey of the motorcycle. The police subsequently submitted final report against the named accused persons and submitted chargesheet against this petitioner. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Khagaria, in connection with S. Tr. No.62 of 2019 arising out of Allauli P.S. Case No.40 of 2016, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
