The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 354, 307, 325, 379/34 of the Indian Penal Code.
The prosecution case is that co-accused Om Chaurasiya threw hot water on the informant. When the informant made protest then Om Chaurasiya and his wife assaulted the informant. It is further alleged against the petitioner that he snatched ear ring from the wife of the informant and snatched Rs.5,000/- from the pocket of the informant.
It is submitted by the learned counsel for the petitioner that accusation of assault is not levelled against the
Patna High Court Cr.Misc. No.18 of 2016 (2) dt.05-01-2016 petitioner and the wife of co-accused Om Chaurasiya, Muni Devi filed Saharsa P.S. Case No. 188 of 2015 against the informant at earlier point of time, wherein the informant has been charge-sheeted. Hence, as retaliatory measure the present case has been filed. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 227 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
