The petitioner apprehends his arrest in a case registered for offences punishable under Sections 406, 420, 506/34 of the Indian Penal Code.
It is contended on behalf of the petitioner that First Information Report has been lodged after two and half years with allegation that the petitioner and two other co-accused have taken money from the informant and did not do the needful for sending him to a foreign country for employment. It is alleged that three persons have taken altogether 89,500/-.
Learned counsel for the petitioner submits that the petitioner is ready to return back one third of the aforesaid amount, i.e., Rs. 30,000/-.

No.37964 of 2016 (2) dt.30-09-2016 2/2 Having regard to the aforementioned facts and circumstances of the case, let the above named petitioner in the event of arrest/surrender before the court below within a period of six weeks from today be released on provisional anticipatory bail for two months after payment of Rs. 10,000/- in Jamo Bazar P.S. Case No. 51 of 2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
Further, after payment of Rs. 10,000/-, the rest amount of Rs. 20,000/-, as undertaken by the petitioner, would have to be paid within two months. Thereafter, if the amount is paid before the court below within two months, the provisional bail granted to the petitioner would be made absolute. The informant would be at liberty to withdraw such amount. However, such payment would be subject to the result of the criminal trial and without prejudice to the stand which he would be taking in the trial. (Dr. Ravi Ranjan, J) Spd/- U T
