The petitioner apprehends his arrest in Kotwali P.S. Case No. 370 of 2016 registered under Section 379 of the Indian Penal Code.
The learned counsel for the petitioner submits that the petitioner is not named in the first information report and nothing has been recovered from the possession of the petitioner. It appears, from the perusal of the case diary that the petitioner was apprehended with the motorcycle, on chase, which was stolen in this case.
Considering the fact that the stolen motorcycle was recovered from the possession of the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. The prayer for anticipatory bail is rejected. (Prabhat Kumar Jha, J) SA/- U √ T √
