JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned A.P.P. for the State. The petitioner prays for anticipatory bail in connection with Bousi PS case no. 53 of 2015 registered for the offences punishable under Sections 341, 323, 307 of the Indian Penal Code. It has been submitted on behalf of petitioner that F.I.R. has been lodged against unknown. Later on, police has also submitted final form, finding the case not true against the accused and on notice to the informant, he has raised no objection but learned Magistrate has taken cognizance after perusal of the case diary. Heard learned A.P.P. as well as learned counsel for informant also. Learned counsel for the informant has drawn my
Patna High Court Cr.Misc. No.50413 of 2016 (2) dt.21-12-2016 attention towards the fact that petitioner is also an accused in another case.
Having heard both sides and in view of the fact that in the present case, FIR has been lodged against unknown and police has also submitted final form finding the case not true against the accused and further that the learned Magistrate has taken cognizance against the accused, let the abovenamed petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/-(Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-6th, Araria in connection with Bousi P.S. case no. 53 of 2015 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that he will cooperate in the enquiry as well as trial of the case and he will make himself available before the court on each and every date except on genuine grounds for his absent.
