The petitioner apprehends his arrest in Rajauli P.S. Case No. 170 of 2016 registered for the offences punishable under Section 47(a) of the Bihar Excise Act (Amendment) Act. The police intercepted scorpio vehicle bearing Registration No. DD03C-0118 and on search Indian made foreign liquor of different brands were recovered. The driver of the vehicle was not apprehended on the spot. The petitioner is owner of the vehicle.
Learned counsel for the petitioner submits that the petitioner entrusted the vehicle to his driver for plying on road but, the driver was doing illegal work by carrying different brands of liquor.
Patna High Court Cr.Misc. No.36740 of 2016 (3) dt.18-11-2016 2/2 Considering the facts aforesaid and the fact that the petitioner is owner of the vehicle, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in Rajauli P.S. Case No. 170 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
