JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-09-2016 Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Bibhutipur Police Station Case No. 117 of 2016, disclosing offences under Sections 272/273 of the Indian Penal Code and Section 47 (a) of the Bihar Excise Act.

From a tempo, owned by the petitioner, the Police recovered huge quantity of foreign liquor (112 bottles).

Considering the fact that the foreign liquor, in huge quantity, was recovered from the tempo, which belonged to the petitioner, I am not inclined to grant the

Patna High Court Cr.Misc. No.36822 of 2016 (2) dt.08-09-2016 2/2 petitioner privilege of anticipatory bail.

This application for anticipatory bail, is hereby, rejected.

The petitioner, Ashok Kumar, is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
