The petitioner is apprehending her arrest in a case registered under Sections 341, 323, 307, 498(A)/34 of the Indian Penal Code and Sections 3⁄4 of Dowry Prohibition Act. Later on, Sections 304(B)/34 of the Indian Penal Code have been added. Allegation is that the accused persons including the petitioner caused death of the sister of the informant due to nonfulfilment of demand of dowry. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent and there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in this case. The petitioner is the sister-in-law (Gatani) of the deceased.

Patna High Court CR. MISC. No.27126 of 2023(2) dt.24-06-2023 2/2 She is separate in mess and property from the husband of the deceased. The husband of the deceased is in custody. On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below/concerned Court in connection with Kursakanta P.S. case No.115 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
